These Terms & Conditions govern your use of services provided by Midfield Ventures Pty Ltd. By engaging our services, you agree to these Terms. These Terms are designed in accordance with the Australian Consumer Law and relevant business regulations.

1. Nature of Services

Midfield Ventures Pty Ltd provides consultancy services only in relation to the sourcing and importation of vehicles into Australia. We provide guidance, advice, and end-to-end support, and assist with sourcing, inspections, auctions, shipping, and compliance coordination. We do not act as a vehicle dealer, buy or sell vehicles directly, hold stock or inventory, or act as the importer of record. All purchases and transactions are conducted in the client's name and at the client's direction.

2. Service Fee

A flat consultancy fee of AUD $1,100 applies per vehicle engagement (unless otherwise agreed in writing). This fee covers advisory and coordination services only. The fee is independent of vehicle price and no commissions are charged.

3. Payment Terms

Payment terms will be agreed prior to commencement of services. Fees may be required upfront or in staged payments. Services may be paused or withheld until payment is received.

4. Client Responsibilities

By engaging our services, you agree that you are responsible for all purchasing decisions, will review and approve vehicles before bidding or purchase, will ensure funds are available for vehicle purchase, shipping, taxes, and compliance, and understand the risks associated with importing vehicles.

5. Third-Party Services

We may coordinate with overseas exporters, inspection services, shipping providers, and Registered Automotive Workshops (RAW). These third parties operate independently. We do not control or guarantee their performance, pricing, or timelines.

6. No Guarantee of Outcomes

While we aim to provide high-quality guidance, we do not guarantee success at auctions, vehicle availability, shipping timelines or costs, or compliance approval outcomes. All outcomes depend on external factors beyond our control.

7. Vehicle Condition and Risk

Vehicles sourced internationally may have unknown or undisclosed defects. Inspection reports are based on third-party assessments. We are not responsible for the mechanical, structural, or cosmetic condition of any vehicle. The client accepts all risks associated with vehicle condition.

8. Import Regulations and Compliance

Vehicle importation is subject to Australian laws and regulations including requirements from the Department of Infrastructure. The client is responsible for ensuring eligibility for import. Compliance must be completed through a Registered Automotive Workshop (RAW). Regulations may change and may impact the import process.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any direct, indirect, or consequential loss arising from vehicle purchase decisions, auction outcomes, shipping delays or damages, compliance issues or failures, or third-party services. Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law.

10. Refund Policy

Consultancy fees are generally non-refundable once services have commenced. Refunds may be considered at our discretion in exceptional circumstances.

11. Cancellation

Either party may terminate the engagement at any time. Fees paid for completed work are non-refundable.

12. Intellectual Property

All materials, guides, and processes provided by us remain our intellectual property and must not be reproduced or distributed without permission.

13. Privacy
